These Terms of service are an agreement between you and Partial, Inc. (Evals, we, us), the operator identified below. By checking the agreement box, you accept these terms. You must be at least 18 and legally able to enter this agreement under the laws that apply to you. If you act for a company or other organization, you confirm that you can bind it, and “you” includes that organization. You can browse public pages without creating an account; browsing or signing in does not enable optional dataset or email permissions.
Keep your account information accurate, protect your sign-in and connected accounts, and tell us promptly about suspected unauthorized access. Do not transfer your account or let another person use it to evade a restriction. You are responsible for the activity and agent actions you authorize. This does not make you responsible for a security failure or unauthorized charge caused by Evals.
Evals is a public evaluation and discovery service. Your contributions include prompts, task inputs, uploaded files, agent outputs, result histories, recorded setups, comparisons, preferences, annotations and comments. Other people may view public contributions and reuse them through Evals. Public profiles and comments identify you by your profile name. An interface that displays only part of a record does not make the rest confidential. We do not offer a private-work setting under these terms.
Do not submit credentials, confidential employer or client work, sensitive personal information, or personal information you are not authorized to disclose publicly. Connected-account tokens, payment details and your account email are not public contribution fields. Credential protections cannot make a secret placed in a prompt, file or output private. Search engines and other people may keep copies outside our control.
You are responsible for the inputs you submit, the actions you authorize, and your use or distribution of results. You represent that you have the rights, permissions and authority necessary for Evals and its service providers to process those inputs, operate the public service and exercise the licenses you expressly grant. This includes copyright, trademark, privacy, publicity, confidentiality, and employer or client permissions. Do not submit material that infringes another person’s rights or breaches an obligation you owe them.
Review generated outputs before publishing, reusing or relying on them, including code, factual claims and material depicting another person. You may grant rights in an output only to the extent you hold those rights. An AI result is not proof of permission, accuracy, originality or copyright protection. We do not require you to claim ownership of rights that a provider or another person holds.
You retain any rights you have in your contributions. You grant Evals a worldwide, nonexclusive, royalty-free license to host, store, reproduce, display, perform, distribute and adapt them as needed to provide the public service, preserve evaluation evidence and support reuse of recorded setups. We may sublicense those rights to service providers performing these functions and to other users for viewing, copying and forking public work through Evals. We may transfer this service license with a lawful transfer of the service, subject to applicable privacy rights. It does not transfer ownership to Evals.
Public availability does not authorize every downstream use. Third-party code, files, skills, model outputs and likenesses remain subject to their owners’ rights and applicable licenses. Respect those restrictions when reusing work. The service license does not grant Evals the separate optional rights to sell datasets to external labs or train models. Those uses are governed by your dataset choices and the Dataset use notice.
The Evals software, branding and other material we supply remain ours or our licensors’. These terms give you permission to use the service as offered, not ownership of it. Do not extract contributions in bulk for resale or external model training without a separate agreement with Evals and the necessary content rights. This restriction does not prevent ordinary use of Evals’ reuse features, rights granted by an applicable open-source license, or uses that the law allows without permission.
You can separately allow Evals to prepare and license eligible future contributions to research organizations and AI labs, including for a fee. Model training requires an additional choice. The Dataset use notice explains the scope, withdrawal and any additional permissions needed for identifiable information or overseas transfers. Neither choice is required to participate. These optional choices govern Evals’ dataset uses; they do not replace the terms governing a model or tool you ask us to use.
Product emails and invitations to paid evaluation or expert opportunities are also separate choices. Invitations do not enroll you in work, share your contact details with employers, promise compensation or create an employment relationship. Paid work requires a separate agreement covering the work, compensation, intellectual property, confidentiality and data handling. Ordinary contributions do not earn payment or royalties unless a separate written agreement provides for them.
Models, tools, connected services and third-party skills have their own terms, privacy practices, licenses and technical limits. You must be authorized to connect an account and use its tools. Connecting an account authorizes the access you request, not unrestricted resale of provider content or training of competing models. Requested tasks may send inputs and necessary context to the providers involved. Review the applicable provider terms before including material in a task.
Agents can make mistakes, create harmful or inaccurate material, and perform consequential actions through tools. Review permissions, spending details, code and results before use. Do not use an output as the sole basis for a medical, legal, financial or other consequential decision. Provider availability, execution time and a particular result are not guaranteed. A provider’s independent service is its responsibility; Evals remains responsible for its own commitments and obligations under applicable law.
Before a purchase or paid execution, review the price, payment source and plan shown in the product. Provider charges and Evals charges may be separate. A connected subscription does not guarantee that every action is included. You authorize the charges you confirm. Recurring payment terms, renewal and cancellation information must be presented at purchase. These terms do not authorize undisclosed charges or a different payer.
Credits are for use in Evals and are not money, an investment or a promise of cash redemption. Contact us about a mistaken or disputed charge. Any disclosed purchase terms and mandatory refund or consumer rights apply, including when access is restricted or the service is discontinued.
Do not use Evals to request, create, upload, distribute or facilitate child sexual abuse or exploitation, sexual content involving a minor or someone depicted as a minor, grooming, trafficking, or nonconsensual intimate content, including sexual deepfakes. These rules apply to real, synthetic, animated and altered material. Pornography and explicit sexual content are not permitted. Lawful, nonsexual medical, educational or artistic material is not prohibited merely because it depicts a body; this does not create an exception for child exploitation or intimate-image abuse.
Do not infringe intellectual-property, privacy, publicity or confidentiality rights; publish unauthorized personal data; doxx, threaten or harass people; impersonate another person deceptively; facilitate fraud, violence, exploitation or other unlawful activity; distribute malware; or compromise an account, network or system without authorization. Do not misrepresent ownership, consent or the source of material.
Do not manipulate votes or evaluation evidence deceptively, bypass safety, access, payment or spending controls, evade a suspension, interfere with service operation, or help others do so. These restrictions cover prompts, attachments, outputs, comments, profiles, links and tool actions. Follow applicable law, content licenses and provider restrictions.
Evals may, in its discretion and subject to applicable law, decline a request, stop execution, restrict distribution, edit or remove a contribution, disable access to material, or suspend or terminate an account. We may act to enforce these terms, address suspected violations, comply with law, protect safety, security or others’ rights, prevent abuse or nonpayment, or discontinue hosting material for legitimate service reasons. A prior violation, court order or final determination of infringement is not required before we restrict material.
Urgent action may occur without advance notice. Where appropriate and lawful, we will explain a restriction and you can contact us to request review. We may preserve restricted records for a legal obligation, investigation, security incident or dispute rather than erase them immediately. We do not promise to screen every contribution before it is made available, and publication is not our endorsement or verification of it. This does not reduce any duty the law imposes after we become aware of harmful or unlawful material. Mandatory refund and consumer rights remain available.
You do not need an Evals account to report a safety, privacy or rights concern. Email the contact below with the affected Evals URL, the reason for the report and a way to contact you. Do not attach child sexual abuse material, intimate images or other sensitive evidence to an ordinary support email. Provide links and a description so we can arrange an appropriate review. We may restrict access while investigating, request reasonable verification, and disclose or preserve information when required by law.
For nonconsensual intimate images, including sexual deepfakes, identify the material and where it appears, provide contact information and a physical or electronic signature, and state in good faith that it was published without consent and that you are the depicted person or authorized to act for them. Where the US TAKE IT DOWN Act applies, we remove material covered by a valid request within 48 hours and make reasonable efforts to identify and remove known identical copies. We handle other requests under the applicable law. We report apparent child sexual exploitation to the appropriate authorities when required by law.
Send copyright notices to Partial, Inc. at the email or mailing address below. Identify the copyrighted work, the allegedly infringing material and its Evals location, your contact information and your physical or electronic signature. Include a good-faith statement that the use is not authorized by the owner, its agent or the law, and a statement that the notice is accurate and, under penalty of perjury, that you are authorized to act for the owner. We may remove or disable access to material and terminate repeat infringers in appropriate circumstances.
If your material was removed by mistake and the US DMCA counter-notice process applies, you may submit your signature, the removed material and its former location, a statement under penalty of perjury of a good-faith belief that removal resulted from mistake or misidentification, your name, address and phone number, and consent to the jurisdiction of the federal district court for your address (or, outside the United States, any federal district where Evals can be found). You must agree to accept service of process from the person who sent the notice or their agent. We may forward a notice or counter-notice, including the necessary contact details, to the other party. Under that process, eligible material may be restored after 10–14 business days unless we receive notice of a filed court action; separate lawful grounds for restriction may still apply. Do not knowingly submit a false notice or counter-notice.
To the extent permitted by applicable law, you will indemnify Partial, Inc. and its officers, directors and employees against third-party claims, damages, liabilities and reasonable legal costs to the extent caused by your inputs, your violation of these terms or applicable law, your unauthorized use or distribution of outputs, or your intentional misuse of Evals. This means reimbursing those losses when you are responsible for them. It does not require you to cover losses caused by our own breach of law, negligence or misconduct, or responsibility that the law does not allow us to shift to you.
We will give you reasonably prompt notice of a claim and reasonable cooperation. We may participate in the defense with counsel of our choice at our expense, except for reasonable defense costs covered by the preceding paragraph. Neither party may settle a covered claim in a way that imposes an admission, payment or other obligation on the other without its written consent, which must not be unreasonably withheld. These obligations survive account closure for claims relating to your conduct while using Evals.
To the extent permitted by law, Evals, third-party content and generated results are provided as is and as available. We disclaim implied warranties of merchantability, fitness for a particular purpose, title and noninfringement. We do not guarantee that results are accurate, safe, complete, unique, copyrightable, free of third-party rights or suitable for your intended use, or that execution will be uninterrupted or error-free.
These disclaimers do not override express commitments we make, mandatory consumer protections, or liability that the law does not allow us to exclude. You remain entitled to any nonwaivable remedy for a service we fail to provide as required by law.
To the extent permitted by applicable law, Partial, Inc. and its officers, directors and employees are not liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue, business opportunities, goodwill or data, arising from these terms or the service. This applies whether a claim is based on contract, tort or another legal theory, even if the possibility of such loss was known.
To the extent permitted by applicable law, their total aggregate liability arising from these terms or the service will not exceed the greater of US$100 or the amount you paid to Evals for the service giving rise to the claim during the 12 months before the event giving rise to it. Amounts paid directly to an independent provider are not amounts paid to Evals.
Neither the exclusions nor the cap applies to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability or remedy that cannot lawfully be excluded or limited. Nothing in these terms limits a mandatory refund or a nonwaivable consumer, privacy or other statutory right. These limits apply only where and to the extent the law permits; they do not make Evals exempt from its legal duties.
You can stop using Evals and request account or contribution deletion in Settings or through the contact below. Deletion is subject to applicable law and limited legal, security and dispute retention described in the Privacy notice. We cannot guarantee removal of public copies held by others. Lawful copies or forks made through the service may remain subject to the applicable service license, unless removal is required by law. Retained restricted records do not authorize new optional dataset use.
We will publish material changes as a new notice version and give notice and request renewed agreement where required. Changes apply prospectively; a new optional purpose is not authorized merely because you continue using Evals. You may stop using the affected feature if you do not agree. Accrued payment obligations, permitted licenses for lawful existing reuse, responsibility for covered claims, disclaimers, liability limits and dispute provisions survive termination to the extent they can lawfully do so. Survival does not override deletion duties or withdrawal of an optional permission.
Contact us first if you have a concern so we can try to resolve it. Unless mandatory law requires otherwise, Delaware law governs these terms, without its conflict-of-laws rules, and the state and federal courts in Delaware have nonexclusive jurisdiction. These terms do not require arbitration or waive participation in a class action.
If you are a consumer, mandatory protections where you live continue to apply, including any right to bring a claim in your local courts. For Korean users, these terms do not exclude protections under the Personal Information Protection Act, the Act on the Regulation of Terms and Conditions or other applicable consumer laws, or shift liability for our intentional conduct or gross negligence.
These terms, the Dataset use notice for any choices you enable, and any applicable purchase or separately accepted feature terms form the agreement for the relevant service. The Privacy notice explains our handling of personal information; it is not a blanket consent to optional processing. A separate signed agreement controls a conflict for the subject it expressly covers.
If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision once is not a waiver. You may not assign this agreement without our consent. We may assign it as part of a lawful merger, acquisition, reorganization or transfer of the service, subject to required notice and applicable privacy and consumer rights. No transfer expands the permissions you granted. No third party has rights under these terms except the persons expressly protected by the claims and liability provisions.
